Agreement to Terms
By accessing or using the online courses (the “Courses”) offered by Scoopearth (“we”, “us”, “our”, “Scoopearth”), you (“you”, “the Student”, “Participant”) agree to be bound by these Terms & Conditions (the “Terms”) and our Privacy Policy. If you do not agree to these Terms, you must not access or enrol in the Courses.
Enrollment & Eligibility
2.1 You confirm that you are legally capable of entering a binding contract and are at least [18] years of age, or if you are a minor, you have obtained consent from your parent or legal guardian.
2.2 To enrol in a Course, you must provide accurate, complete and current information as requested during registration.
2.3 We reserve the right to refuse or cancel enrolment of any participant at our discretion.
Course Offering & Access
3.1 We will make the Course available to you as described on our website, subject to these Terms.
3.2 Access to the Course content is typically provided via online portal, platform, or other means. You are responsible for obtaining and maintaining all equipment, software, internet connection and other requirements to access and use the Course.
3.3 Course access may be for a specified duration (“Access Period”) as described at the time of enrolment. After the Access Period expires, you may lose access to the Course unless otherwise specified.
Fees, Payment & Refunds
4.1 The Course fee (“Fee”) is as communicated at the time of enrolment and must be paid by you in full using accepted payment method(s).
4.2 All payments are in Indian Rupees (INR) unless otherwise stated. You are responsible for any taxes, charges, or currency conversion fees.
4.3 Unless otherwise stated, all sales are final. We do not offer refunds except as required under applicable law or for valid cause as may be agreed by us in writing.
4.4 In the event of non-payment, we may suspend or cancel your access to the Course without refund.
Intellectual Property
5.1 All Course content, materials, modules, videos, handouts, downloads and other materials (collectively “Course Materials”) provided by Scoopearth are our property or licensed to us and are protected by copyright, trademark and other intellectual property laws.
5.2 You are granted a limited, non-exclusive, non-transferable licence to access and use the Course Materials for your personal, non-commercial use for the duration of your access.
5.3 You may not reproduce, distribute, share, publicly display, publish, adapt, upload, transmit or create derivative works of the Course Materials except as expressly permitted in writing by us.
5.4 You may not sell or resell access to the Course or Course Materials, nor permit others to use your account or credentials to access the Course.
Acceptable Use & Conduct
6.1 You agree to use the Course and our platform only for lawful purposes and in compliance with these Terms.
6.2 Prohibited conduct includes (but is not limited to):
- infringing the rights of others;
- interfering with our services or systems;
- posting or uploading harmful, abusive, defamatory or illegal content;
- sharing your login credentials or allowing others to access your account;
- using bots, scripts, or other automated means to access or use the Course.
6.3 We reserve the right to suspend or terminate your access if you breach these Terms, misuse the Course, or engage in illegal or harmful behaviour.
Termination & Suspension
7.1 We may suspend or terminate your access to the Course at any time, with or without cause, including if you breach these Terms or for system maintenance or other operational reasons.
7.2 On termination or expiry of your access, you must immediately cease using the Course Materials and, where required, destroy or return any downloaded materials as instructed.
7.3 Termination shall not limit any rights we may have arising from your breach of these Terms.
Disclaimers & Limitation of Liability
8.1 The Course are provided “as is” and “as available”. We make no representations or warranties of any kind, express or implied, regarding the accuracy, completeness, reliability, or suitability of the Course or Course Materials.
8.2 To the fullest extent permitted by law, we exclude all warranties (whether express or implied) including warranties of merchantability, fitness for a particular purpose, non-infringement.
8.3 In no event shall Scoopearth, its directors, officers, employees or affiliates be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or business opportunities arising out of or in connection with your use of the Course, even if advised of the possibility of such damages.
8.4 Our total aggregate liability for any claim arising under these Terms or in relation to the Course shall not exceed the Fee paid by you for the relevant Course.
Updates, Changes & Interruptions
9.1 We reserve the right to modify, suspend or discontinue any aspect of the Course (including features, content or access) at any time, without prior notice and without liability.
9.2 You agree that we shall not be liable if the Course is unavailable at any time or for any period due to maintenance, technical issues, or factors outside our reasonable control.
Privacy & Data
10.1 Your use of the Course is subject also to our Privacy Policy, which governs how we collect, use, share and protect your personal information.
10.2 By enrolling, you consent to our processing of your personal data in accordance with that policy.
Governing Law & Dispute Resolution
11.1 These Terms shall be governed by and construed in accordance with the laws of India.
11.2 Any dispute, controversy or claim arising out of or in connection with these Terms or your enrolment in a Course shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.
General Provisions
12.1 These Terms, together with the Privacy Policy and any enrolment-specific terms communicated to you, constitute the entire agreement between you and us in relation to your enrolment in the Course and supersede any prior or contemporaneous agreements, representations or communications.
12.2 If any provision of these Terms is held invalid or unenforceable, such provision shall be severed and the remainder of the Terms shall continue in full force and effect.
12.3 Your rights under these Terms are personal to you; you may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights or obligations under these Terms at any time without your consent.
12.4 No waiver by us of any default or breach by you shall constitute a waiver of any subsequent default or breach.
12.5 We may amend these Terms at any time by posting an updated version on our website. Your continued use of the Course after any such amendment will constitute your acceptance of the amended Terms. We recommend you review this page periodically.
